WrapFast Terms of Service

Welcome to WrapFast, located at https://wrapfa.st ("Website"). These Terms of Service ("Terms") govern your use of WrapFast, a platform offering a SwiftUI iOS and Node.js backend code boilerplate to aid entrepreneurs and indie developers in launching AI Wrappers or any iOS app quickly, with integration to AI endpoints, including OpenAI.

1. Acceptance of Terms
By accessing or using our Website, you agree to be bound by these Terms, our Privacy Policy (available at https://wrapfa.st/privacy-policy), and any additional terms applicable to certain programs in which you may elect to participate. If you do not agree to these Terms, you should not use our services. This Terms takes effect on the date on which you first use the WrapFast application.

2. Services Offered
WrapFast provides a code boilerplate for iOS app development, including AI integration, and offers development services for a 1-Feature-MVP using the WrapFast Boilerplate.

3. Ownership and Use of Materials
Upon purchasing a plan, you are granted a license to download and use the code for app creation. This license is for your personal, non-commercial use only. You may not resell, redistribute, or transfer the code. All rights not expressly granted to you are reserved by WrapFast.

4. No Refunds
Due to the nature of digital downloads, all sales are final. Refunds will not be provided once the source code has been delivered.

5. MVP Development Specifications
With the proper plan purchase, you can request development of a core feature for your MVP. This includes standard setup provided by the WrapFast Boilerplate. Up to three revisions are allowed, excluding the addition of new features. Project maintenance is not included. Communication for development will be conducted asynchronously via email to juanjo@mail.wrapfa.st or by Telegram.

6. Project Timeline and Delivery
For the MVP development service, the current estimated delivery timeline is displayed on our Website. This timeline provides an approximate schedule for the completion of initial MVP development, starting from the receipt of your core feature request. While we endeavor to meet these timelines, they are estimates and subject to change based on the complexity of the project, the nature of revisions requested, and our current workload. The timeframe for the up to three permitted revisions will also be established upon initial delivery of the MVP. We are committed to keeping you informed of any adjustments to the delivery timeline as they become necessary.

7. MVP Service Evaluation and Price Adjustment
Prior to initiating any MVP development work, we reserve the right to evaluate the feasibility and complexity of the core feature requested by the client. After this evaluation, we may decline to provide the MVP development service if it determines that the project is not feasible within the scope of the services offered or if it exceeds the technical capabilities or resources availability at the time of the request. Furthermore, based on the complexity of the requested core feature, we reserve the right to adjust the price of the MVP development service accordingly. The client will be notified of any such price adjustment and will have the option to proceed with the revised proposal or cancel the request. This evaluation process is designed to ensure that we can deliver high-quality service that meets the client's needs while also managing the expectations and resources effectively.

8. User Data
We collect personal data such as your name, email, and payment information as outlined in our Privacy Policy.

9. Non-Personal Data Collection

10. Disclaimer
It is not warranted that WrapFast will meet your requirements or that its operation will be uninterrupted or error free. All express and implied warranties or conditions not stated in these Terms (including without limitation, loss of profits, loss or corruption of data, business interruption or loss of contracts), so far as such exclusion or disclaimer is permitted under the applicable law are excluded and expressly disclaimed. These Terms do not affect your statutory rights.

11. Warranties and Limitation of Liability
WrapFast does not give any warranty, guarantee or other term as to the quality, fitness for purpose or otherwise of the software. WrapFast shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by WrapFast's negligence or the negligence of its servants or agents or otherwise) which arise out of or in connection with the provision of any goods or services by WrapFast. WrapFast shall not be liable or deemed to be in breach of contract by reason of any delay in performing, or failure to perform, any of its obligations if the delay or failure was due to any cause beyond its reasonable control. Notwithstanding contrary clauses in these Terms, in the event that WrapFast are deemed liable to you for breach of these Terms, you agree that WrapFast's liability is limited to the amount actually paid by you for your services or software, which amount calculated in reliance upon this clause. You hereby release WrapFast from any and all obligations, liabilities and claims in excess of this limitation.

12. Responsibilities
WrapFast is not responsible for what the user does with the user-generated content.

13. Governing Law
These Terms shall be governed by the laws of Spain, without regard to its conflict of law provisions.

14. Updates to the Terms
We reserve the right to modify these Terms at any time. All changes will be posted on our Website and effective immediately upon posting.
